What The U Visa Is and How to Apply

From U-Visa to Permanent Residence

A U visa is a nonimmigrant visa with an initial validity of four years, although you may be able to request an extension if needed. U visa holders are entitled to a range of significant rights and benefits that can greatly enhance your quality of life in the United States. With the U visa status, you can obtain a driver’s license, open a bank account, and enroll in both academic and vocational education programs. Most importantly, a U visa gives you the right to work legally in the United States, ensuring that you can support yourself and your family independently.


The U visa can also lead to legal permanent residence in the U.S. To be eligible for this adjustment of status, you’ll need to meet certain requirements:


  • Be a valid and current U visa holder
  • Been physically present in the U.S. for a continuous period of three years 
  • Have provided all reasonable assistance to the law enforcement or government investigation and/or prosecution of relevant criminal activity
