Who is Eligible to Apply For SIJS?

Before a petitioner can file for Special Immigrant Juvenile Status, a state juvenile court must first sign an order determines:


  • The child cannot be reunited with one or both parents due to abuse, abandonment, or neglect 
  • The child is dependent on the state’s child welfare system; is living with a foster family, non-abusive parent, or court-appointed guardian; or is in federal custody
  • That it is not in the child’s best interests to return to their home country


Once that determination is made at the state level, then you can prepare to petition for SJIS. When the petition is files, the applicant must be under 21 years old, unmarried, and currently living in the United States.
