What Is DACA?

The Deferred Action for Childhood Arrivals (DACA) is an immigration program that can provide temporary relief to undocumented immigrants who came to the United States as children, if they meet certain eligibility requirements. While DACA itself isn’t a pathway to legal status or citizenship, it does grant important benefits: the ability to apply for employment authorization, and deferred action on removal proceedings. That means that recipients will not be targeted for deportation while they are covered under DACA. It’s this protection that makes DACA such an important tool for those seeking to continue their lives here in the United States, and to pursue their education and career opportunities.

DACA is a temporary relief program, and lasts for two years, but recipients can apply to renew their status. If you are a current DACA recipient who is up for renewal, our experienced immigration attorneys are here to assist you. Requirements can be strict, and immigration laws are always changing, so having someone on your side who knows them in and out can be a big help.

We also understand that becoming a DACA recipient may not be the end of your immigration journey. The temporary relief granted by DACA is a vital step towards finding a longer-term solution for your residence and employment in the United States. Here at Eastbridge, our team is committed to finding the best way forward for you, taking into account your unique situation and your goals.

Our attorneys offer free initial evaluations over the phone, as well as longer, situation-specific paid appointments for more detailed guidance.

DACA Eligibility Requirements

The best way to know if you’re eligible to apply for or renew DACA is to speak with an experienced immigration attorney. They can walk you through all the details, and look at the specifics of your circumstances to determine where you stand. Here are the basic criteria you must meet to apply for deferred action:

Born on or after June 16, 1981

  • Came to the US before your 16th birthday
  • Have lived in the US continuously between June 15, 2007 and your application for DACA
  • Had no legal status in the US on June 15, 2012, or when you applied for DACA
  • Be currently enrolled in school, or have graduated and completed high school or earned a GED, or have been honorably discharged from the U.S. Armed Forces or Coast Guard
  • Have not been convicted of a felony, serious misdemeanor, or three less serious misdemeanors

Our immigration team at Eastbridge has many years of experience in determining whether seeking immigration relief through DACA is the right step forward for our clients. Their attentive, professional guidance can help you understand the eligibility requirements, and support you through every other step of the application or renewal process.

DACA was designed to help some of the most vulnerable people impacted by the immigration system. It has served to give relief and opportunity to those who came to the U.S. as children and have built their lives here, whose education and hard work contribute to our vibrant local communities, and whose family and personal ties to this country are strong. Growing up undocumented can be scary, and deferred action can offer relief from that feeling of precarity. When you have a better sense of security, then it becomes easier to plan for your future.

Our Immigration Law team is here to help make sense of the process, and to find the solutions that will work best for you. Get in touch today to get started.
